A judge dismissed a bankruptcy filing by the Harrisburg City Council.

NEW YORK (CNNMoney) -- A federal judge Wednesday dismissed a bankruptcy petition filed by Harrisburg's City Council, saying that it violated state law.
The ruling now paves the way for the state to deal with Harrisburg's massive debt problem. A Pennsylvania court should decide by mid-December whether to approve Gov. Tom Corbett's candidate to serve as receiver for the troubled capital city.
The council, which has repeatedly tried to keep the state out of Harrisburg's affairs, had hoped to retain some control and force creditors to forgive some of the debt.
But federal bankruptcy Judge Mary France ruled the council's action was not authorized by state law, which prohibited the city from filing for bankruptcy. She also said the petition would not have been legal because it was not approved by the mayor.
The council voted in mid-October to file for Chapter 9 bankruptcy protection. The council's attorney, Mark Schwartz, said he would have to read the judge's order before he and city lawmakers decide whether to appeal.
Harrisburg's fate now lies in the hands of a state receiver. Corbett has nominated David Unkovic, a bond attorney who served until last week as chief counsel for the state Department of Community and Economic Development.
If approved, Unkovic would have until mid-January to come up with a plan to deal with the city's debts. The mayor and city council president will serve on the receiver's advisory board.
The financial turmoil in Harrisburg dates back 10 years, when the city decided to upgrade a trash incinerator. Harrisburg was counting on revenue from the project to cover the cost of financing it. Instead, it has left the city with $310 million in debt.
The situation at the state capital, with just under 50,000 residents, has grown more bleak over time. And that has set up a battle, with Mayor Linda Thompson and state officials on one side, and the city council on the other.
The mayor, who took office last year, has strongly opposed bankruptcy, calling it an option of last resort.
Thompson has turned to the state for help several times. A year ago the Pennsylvania state government gave the city $4.3 million to help stave off a bankruptcy threat at that time.
The mayor also petitioned the state last year to enter its distressed municipalities program, which prompted a state consultant to come up with a recovery plan. Under a state law approved earlier this year, distressed cities cannot file for bankruptcy or they risk losing state aid.
However, the city council rejected the state's plan this summer, as well as a similar proposal drawn up by the mayor. That proposal called for selling the incinerator and leasing the city's public parking lots.

Thompson on Tuesday released a 2012 budget that calls for a property tax hike of roughly $50 to $100 for most Harrisburg residents, as well as a hiring freeze and cut in spending. Most city workers would also see their wages frozen.
The council must vote on the budget by Dec. 31.
The rejection of the bankruptcy filing allows Harrisburg to move forward, said Robert Philbin, the mayor's spokesman.
"Now the city can get focused on working with the receiver to get the city to financial solvency," Philbin said.

- RM29.8bil has been allocated for investment in infrastructure, industrial and rural development

- RM13.6bil has been allocated for the social sector, including education and training, welfare, housing and community development

- Total revenue for 2012 is forecast to increase 1.9% to RM186.9bil and the deficit to decrease to 4.7% of GDP from 5.4% in 2011

- The theme for Budget 2012 is “National Transformation Policy: Welfare for the Rakyat, Well-Being of the Nation”

- We will focus on accelerating investment and further liberalise 17 services sub-sectors, in places enabling 100% foreign equity.

- RP2 will be implemented in 2012, and it will be allocated RM98.4bil, to be split evenly between 2012 & 2013

- RP2 main projects will include the East Coast Highway from Jabor to T’ganu and road upgrades from Kota Marudu to Ranau

- To promote the development of Exchange Traded Funds products I-VCAP will provide RM200mil for Shariah-compliant ETFs

Hospitals will be upgraded and constructed as well 81 rural health clinics upgraded and 50 new 1Malaysia clinics launched.

Healthcare will be allocated RM15bn operating expenditure and RM1.8bn development expenditure.

The Government will establish the Special Housing Fund for Fishermen to build and refurbish houses.

RM15mln will be allocated to build 150 futsal courts to achieve the “One Court for One Mukim” target.

The Government will establish MyCreative Venture Capital with an initial fund of RM200mln.

To prevent cervical cancer, the Government will provide free Human Papilloma Virus immunisation nationwide.

A training allocation of RM10mln will be provided for women to develop leadership and managerial skills.

To assist the homeless the Government established a social assistance centre known as Anjung Singgah.

The National Legal Aid Foundation will ensure that every individual who is charged in court will be given free legal aid.

To assist taxi owners facing increased operating costs, measures will be introduced including tax exemptions on taxi purchases.

The beautiful game has become even more fabulous. Local jewellers Shimansky have unveiled a ball that is sure to distract even the most capable of goal keepers.

To celebrate South Africa’s first hosting of the FIFA World Cup, Shimansky created the world’s most expensive soccer ball. Weighing at just over two kilograms, the ball is encrusted with 6,620 white diamonds and 2,640 black diamonds.
According to Shimansky’s marketing manager, Michele Meyer, the ball, which is the first of its kind, took over three months to conceive and design. Meyer adds that the idea was to commemorate the first hosting of the prestigious tournament in an African country from a jewellers perspective.
The blinged-out ball contains a total of 3,500 carats worth of diamonds and is worth an estimated R20 million. Shimansky are said to be in talks with a European football club to purchase the ball after the tournament. If you’d like to remember the tournament in your own way, there are exact crystal replicas of the ball which will be auctioned off for charity at the much more wallet-friendly price of R8000.

n the year since I started blogging, I’ve gotten a bunch of freelance writing gigs and regular jobs writing all over the Web. But, initially, no one offered them to me. I had this blog I was proud of, a super-cool design, and yet the offers didn’t flood in. Crazy, right? Tell me about it.
I finally decided that if I wanted something to happen, I had to go and get it. So I did the simplest thing I could think of: I just asked for it. I wrote to a bunch of different sites, and asked if they needed writers. I pitched a few ideas, used my blog as a resume, and offered my services.
I couldn’t give you an exact number, but the response rate to my emails was extraordinarily low. Let’s just say that if I were a baseball player with that batting average, I wouldn’t be a baseball player much longer. Only a couple of people responded at all, and a few of those turned into the jobs I got initially as a freelance blogger. But my batting average wasn’t high.
And it didn’t matter. For the opportunities that didn’t come my way, all it cost me was a few minutes of my time to send an email. The hour it took to write ten emails, even if it only generated one response, was well worth it just for that one response.
I got my dream job this summer from exactly the same thing: I sent an email. I can’t explain why it worked, or why I got a response instead of the hundred or so other people my boss got applications from. It worked, though, and for one reason: I asked. If I never heard back, so be it; it’s a wasted ten minutes. But I did, and it became a fantastic experience for me.
Simply asking is the most useful marketing tool I’ve ever discovered. You can have a spectacular resume, the most polished skill set, and the perfect passions for a job or opportunity, but if you don’t ask for it, who’s going to know you want it? Asking, handled the right way, leads to nothing but positive results.
If you’re anything like me, you’re afraid of asking for things – especially things you really want. I think the problem is that we so fear getting turned down that we run away, in order to be able to somehow hold out hope that we’re good enough for it. Asking, and getting rejected, would somehow only prove our failure and our ineptness for what we really want.
The reality, though, is that there are a ton of reasons why an opportunity didn’t come along, most of which have nothing to do with you being a failure: there’s timing, restrictions, personality issues, and a whole litany of other reasons why the opportunity’s not right for you at the moment. Maybe your email just got lost, or maybe the person doesn’t like people with your name – whatever it is, not winning mean doesn’t mean you’re a loser. That can be hard to understand, but not getting down because your batting average isn’t perfect is key to success.
The more opportunities you put yourself out for, the more you’ll get. Do you want something, whether it’s a job, a cookie, or something else? Ask for it. Do it in a respectful, productive way, and you’ll get a response in kind – even if it’s no. Don’t let the no’s bog you down, and remember: the second “Yes!” is always easier than the first.

When I started my first business, which was an ice cream company, I had no money, I had no business experience, and I had absolutely no idea how to make ice cream. Five years later, my ice cream was judged to be the best in America by People Magazine. (See April and May 2005 archives of this blog for the whole delicious story.)
What drove the growth of my business was the growth of my knowledge of ice cream. And what drove the growth of my knowledge of ice cream was my love for the stuff.
When you start a business, what must lead the way should be your own interest in or love for whatever it is you want to do. Loving what you do miraculously attracts all the necessary resources, people and opportunities. You definitely don’t need money to start. Bootstrapping will stimulate your creativity and that is worth much more than money anyway.
Besides, money is overrated. I have found through bitter experience that there is always baggage that comes with investors’ money. You take their money and you get their karma too. What may seem like easy money is frequently filled with major headaches and not worth it in the long run. I vastly prefer the freedom and the control that comes with bootstrapping.
But I am also a practical man who like fast-growing businesses. Therefore I have had to take on financial partners of various stripes. I have learned to be VERY fussy about who I partner with. But that is a whole other story.
One more thing: Your passion doesn’t have to be about any particular product or service. For me, my passion is the process – building teams, collaborating with others, wrestling with creative challenges, supplying customers with value, entertaining paradigm-shifting ideas, dreaming of the potential for fast growth, and being socially responsible to all the stakeholders, not to mention Mother Earth. I am passionate about those things, so if all those elements are present, then it doesn’t make a lick of difference if the end-product is ice cream or telecommunications (my second biz and I knew absolutely nothing about telecom either) or whatever.
